Court Accepting Comments on Procedural Rules, Uniform Traffic Ticket

The Supreme Court of Ohio is accepting public comment until Feb. 13, 2019.

The Ohio Supreme Court will accept public comment until Feb. 13 on amendments to the annual update to the Ohio Rules of Practice and Procedure.

Proposed amendments to various procedural rules seek to implement provisions of the recently enacted Marsy’s Law, which extended new rights to victims of crime. Other proposed amendments would modify the process by which indigent criminal defendants would request expert witnesses or investigators.

The Court also is seeking public comment on proposed changes to the Multi-Count Uniform Traffic Ticket. These proposed changes create an option for law enforcement to check a box indicating that audio-visual evidence of the traffic stop exists. The proposals also update language to conform with previous updates to Traffic Rule 13.

The annual rules update also includes proposed amendments to the rules of civil procedure, criminal procedure, juvenile procedure, appellate procedure, and the Ohio Rules of Evidence.

According to the Ohio Constitution, proposed amendments to rules of procedure must be filed with the General Assembly by Jan. 15, 2019 in order for the amendments to take effect on July 1, 2019. Any additional amendments to the rules must then be filed before May 1, 2019.

Publication of these proposed amendments for public comment at this time does not imply that the Supreme Court endorses or will ultimately approve any or all of the proposed amendments.
