Court Adopts Amendment to Prohibit Multiple Extensions of Time
The Ohio Supreme Court has adopted an amendment to its Rules of Practice that prohibits the filing of multiple extensions of time by parties on the same side of a case.
Prior to the adoption of this amendment, each party that was on the same side of a case was permitted to file a stipulation for extension of time, which effectively increased the total extension of time to file a brief to more than 20 days for all parties on that side.
Beginning March 1, 2020, when the new amendment to Rule 3.03(B)(3) goes into effect, parties no longer will be able to file multiple stipulations for extension of time, and instead each side will be limited to a single 20-day extension of time to file a brief that applies to all parties on that side. The amendment further states that the clerk shall refuse to file requests or stipulations for extension when another party on the same side has already obtained an extension of time.
