The Ohio Supreme Court is accepting public comments until Dec. 4 on proposed new and revised standard probate forms regarding a surviving spouse’s automobile selection and a guardian’s authorization to sell a ward’s house or property.
The proposed changes to probate forms include:
- Updating existing forms to reflect recent legislative changes that removed the cap on the number of automobiles a surviving spouse may select upon his or her spouse’s death and also increased the total allowed value of the selected automobiles from $40,000 to $65,000
- Adopting new forms to implement recently enacted legislation allowing a guardian to sell a ward’s real estate with the written consent of the ward’s spouse and potential heirs.
